Short-Term Rentals (STRs)

On June 9, 2021 the Board of Trustees adopted a new ordinance addressing short-term rentals (STRs). With the new ordinance, the only type of STR allowed is a Bed & Breakfast and all operating STRs, including AirBnBs, VRBOs, and other rentals listed on lodging websites, must obtain an annual B&B license.

Registering a Short-Term Rental

Short-Term Rental is a term used for various types of short-term rentals. Bed and breakfast establishments are the only permitted form of short-term rental in Los Ranchos. This means that the operator must be on the property during rental. You can register your property as a B&B Establishment as the property owner and/or operator.

Those who are only renting out their home or rooms in their home for a portion of the year, such as Balloon Fiesta or the holiday season, are required to have a B&B permit. The permit must be renewed annually and there is a cap of 65 total permits available, as determined by Board of Trustees resolution.

Initial applications are reviewed by the Planning & Zoning Commission at their monthly meetings on the 2nd Tuesday of every month. See the bottom of this page for deadlines to apply for the Planning & Zoning Commission meetings.

    Once you have emailed a complete application with the required supplemental documents to mrubin@losranchosnm.gov, staff will follow up with any questions, requests for documents, and will send you an online invoice for the application and public notice fees. You will be scheduled for the next Commission meeting and staff will call you to pick up a sign you must post on your property visible from the road. Letters will go out to nearby property owners noticing your application on the Commission’s agenda. Any comments or questions staff receive will be forwarded to you. At the Commission meeting, the Commission may decide to approve, approve with conditions, or deny your application. After the meeting, you will receive a notice of decision. If approved, staff will send you your annual business license. Renewal notices are sent in November and are done administratively. License fees are not prorated.

Currently Operating Short-Term Rentals

  • Currently licensed B&Bs will be sent a notice letter outlining the changes and what will be required for renewal next year (2022).

  • Unlicensed STRs that have been operating prior to June 9, 2021 have until October 6, 2021 to apply for a B&B license with the opportunity to be grandfathered in for absent-owner status and more than four (4) guest bedrooms. Village staff will send individual notices with more information to operating STRs, or you can fill out the application form here. Reporting Nuisances

  • Call the 24/7 hotline to report a nuisance complaint at (505) 591-5528.

  • If there is a health or safety emergency, call 911.

  • If there is a nuisance occurring during the Village’s business hours (Monday – Friday 8 am – 5 pm) contact the Code Enforcement Officer at (505) 344-6582.

  • If there is a nuisance occurring outside the Village’s business hours (e.g. evenings, nights, weekends), contact the Bernalillo County Sheriff’s Office non-emergency number (505) 798-7000. You can also visit their website here.

Ordinance

  • STRs must obtain an annual license to operate.

  • Operators must be present on the property for the duration of the rental.

  • No events allowed.

  • Adequate off-street parking must be provided.

  • Rules of operation must be posted that includes information for cleanliness, noise, and emergency service contacts.
